Arraingnment Delayed, Outburst In Court: 'Rot In Hell Holmes'

Centennial, CO (KUSA) -- The Aurora theater shooting suspect's arraignment has been pushed back to March 12. As the hearing was wrapping up Friday, a father of one of the victims yelled at the suspect as he was leaving the courtroom.

District Judge William Sylvester called everyone back to the courtroom in response to the outburst. The man who yelled out 'rot in hell Holmes' to the suspect was identified as Steve Hernandez, the father of Rebecca Wingo, who was killed in the attack.

"I am terribly sorry for you loss. I can't begin to image the emotions that are raging," the judge said.

Hernandez said he did not mean to disrespect the court. 
"Can I count on you to refrain?" the judge asked. Hernandez said yes he would.

Sylvester said he issued a 61-page written order late Thursday night, finding good cause to continue at a later date because both sides did not have proper time to prepare for the case. 

He cites the more than 30,000 pages of documents and 220 DVDs involved in the case.

There were 84 people contacted under the Victims' Bill of Rights who objected to continuance of the arraignment.

Sylvester also said he was empathetic to victims and understands their need for closure. He said he did not want to rush process to make sure everything is done right, in case it is appealed in the future.

In response to the ruling, some victims got up and left the courtroom.

James Holmes is charged with multiple counts of first-degree murder and attempted murder.

If convicted of first-degree murder, he could face the death penalty.
